Will divorce be easier if you separate while you are still young?

Divorce can be challenging at any age, but many wonder if separating while still young or after a short marriage makes the process easier. While age and the length of marriage do play a role, they do not always determine how smooth the divorce will be. 

Understanding some of the factors that complicate divorce can help in assessing if age or the length of a marriage can reduce those complications.

Property division for young couples

One factor that often complicates divorce is the division of property. The state of Texas follows community property laws. This means that any property or income acquired during the marriage is usually split equally between the two spouses. For younger couples or those married for a short time, the amount of community property may be less, leading to a simpler division of assets. However, if the couple has significant investments or complex assets, the process can still become complicated, regardless of age.

Bypassing child custody concerns

If a couple has children, the court must decide on a custody arrangement that serves the child’s best interests. This process can become time-consuming and emotionally challenging, whether the couple is young or older. It goes without saying, though, that younger couples without children will have one less concern during a divorce if they do not have custody matters to resolve.

Determining the need for spousal support

Spousal support, or alimony, is a complicating factor in many divorces. In Texas, courts typically award spousal support only in marriages that have lasted at least ten years. For younger couples in shorter marriages, this may not be a factor, which can make the process smoother.

While some aspects of divorce may be simpler for younger couples, factors like property division and child custody can still present daunting challenges if they arise. The complexity of a divorce often depends on many individual circumstances rather than just age or the length of a marriage.
